How To Comply with CAN-SPAM: An Overview

The following information is paraphrased from the Federal Trade Commission’s site. Visit ftc.gov to read their summary of the CAN-SPAM Act as it pertains to commercial emailers. The following are meant as guidelines only, and should not be interpreted as a full rendering of the CAN-SPAM Act.

The following is an example of a CAN-SPAM compliant email:

Subject: Pat’s Online Store - March Madness Sale

Dear Sam,


Thank you for visiting Pat’s Online Store! As a thank you for your patronage, and for confirming your subscription to our newsletter, please find enclosed a coupon that will give you 10% off your next purchase of $30 or more.

Enter coupon code: 655321 during checkout to receive your discount.

For all of March, enjoy our March Madness Sale! To celebrate, we’ve marked all of our basketball-related products down by 20%. Hurry, the sale ends March 31st.

To opt-out of receiving future email, send a blank email to optout@example.com

There are four basics requirements set forward by CAN-SPAM:

  1. All header information must be accurate and reflect the originator of the email.
  2. Subject lines must reflect what is contained in the email, and not mislead the recipient as to the contents of the email.
  3. You must give the recipient a clear means by which to opt-out of future email.
  4. All commercial email must be clearly identified as such, and the physical postal address of the sender must be included.

The best method of newsletter subscription is a double opt-in. This basically involves having visitors sign-up to receive email from you. The first email you send them prompts them to confirm that they want to receive future email from you.
